1/22/2007 美国违宪法律的影响消除问题前些天看美国法律的书，想到这样一个关于违宪法律的问题：
一项于数十年前生效的法律在2007年1月被最高法院在某CASE中宣布为违宪无效。 情况1 某人在这一CASE中依据该法在2005年被判入狱6年，至今仍在服刑； 情况2 某人在这一CASE中依据该法在2004年被判入狱1年，现已出狱； 情况3 某人在这一CASE中依据该法在2006年12月被判入狱，正在向巡回法院上诉。 如果最高法院是依据这一CASE宣布该法违宪，以上三种情况的当事人都曾入狱，情况 1、3下能否被释放？三种情况是否都能申请国家赔偿？
如果最高法院是依据其他CASE宣布该法违宪，又会怎么样？ 简单地说，最高法院依据某一CASE宣布某法违宪，其判决是否影响依据该法判决的所 有CASE？
如果是20年前的案件还能否推翻？如果最高法院以前曾依据该CASE判决，该案件又如

About 2800 people died in the disaster. At the time the recovery and site clearing process officially concluded on May 30, 2002, 1796 people remained unrecovered. 1.8
