The role of the Supreme Court

A new act passed by the China’s National People’s Congress recently has declared that the right to explain the laws is given to the Standing Committee of the NPC. In America, this right is owned by the Supreme Court. Actually, the constitution didn’t clearly regulate it. Who gave this power to the Supreme Court? The answer is: The Supreme Court itself.

In 1803, through the case Marbury v. Madison, the chief justice John Marshall declared that only the Supreme Court has the right of “Judicial Review”. Since the American law system is composed of cases, judgements and law explanations, this right was confirmed since then. Today, this right is considered to be the most powerful weapon of the court. If a law is declared “unconstitutional”, only two ways can save it: one is the Supreme Court overturn its own judgement, the other is to pass the amendment of the constitution. So as the chief judge Charles Hughes once said: “We are under a Constitution, but the Constitution is what the judges say it is.”

Among all the institutions of administration, law making and judicature, judges are honored as the top in the U.S... Judges can work till retire after appointment and they can’t be dismissed from his post without serious mistakes. This rule successfully guaranteed the fair and square of the judges. The judgment of the Supreme Court is the last instance, so as the justice Robert Jackson said, “We are not final because we are infallible, but we are infallible only because we are final.” This status makes the Federal Supreme Court very important in American’s political life.

In 2000, George.W.Bush and Albert Gore scrabbled for the throne of the president. At last, the votes in Florida are controversial. At last, the Supreme Court——a institution not elected popularly decided Bush won the election. If this happens in some other countries as Ukraine and Georgia, supporters of the candidates will have already fired in front of the parliament building. Through this case we can see the American people’s honor to the court and the power of it. Without the support of the public, the judgement from the court will just be a useless paper.

 

Differences between “Rule by law” and “Rule of law”

After reading these books, I think though there is only one difference in the use of a preparation, the meanings are absolutely not same. The subject of “Rule of law” is the law, it means the constitution is the ultimate law of the country, any one or any thing will be illegal if it is judged as “unconstitutional”; however, the subject of “Rule by law” is canceled deliberately or unintentionally. WHO rule the country by law? If the relationship between “who” and “law” is not clearly defined, “Rule by law” may change into “Rule by person”.

Of course, the law can’t rule itself. It needs some one or some institutions to explain or execute it. In English, the word “Constitutionalism” means through a serious of judgements, law explanations, gradually building a system of laws based on the constitution, in order to manage the country. While in Chinese, “Constitutionalism” means “Democratic politics”. Just like Mr. Sun Zhongshan imagined, all the countries have to pass the three stages: rule by army, rule by leaders and rule by the constitution.

Through the different understandings of the sentences between Chinese and Americans, we can see the spatial difference on law system and conceptions between two countries. A modern country should respect his constitution and laws as the manager, not the ornament. Only then can we regard the country as a democratic one. We should “Rule the country by law” under the spirit of “Rule of law”. That’s the difference between them. That’s why I choose it as the title.

 

Some ideas after reading

In today’s world, nearly every country has its own constitution. But how many countries are really ruled by law? A constitution without constitutionalism is just a beautiful vase for the ruler to decorate his guilt. In human’s history, there were many perfect constitutions compared with the U.S., they tried to build a heaven on the earth. Unfortunately, most of them became jokes for the descendants or even the hell for the ordinary people. Since we have the burden to build China a “Strong, democratic and civilized socialist country”, the spirit of law should stay firmly in our brain.

The constitution of America is much shorter than many constitutions (With only several thousand words), but it also has a longer life than them. It’s a foundation, not an entire building; it’s a root, not a flourish tree; it’s rather simple, but also left enough space for the descendants to develop it to adapt new conditions. Without the Supreme Court to explain it, without every president to honor it, without the spirit of law shared by the public, it’s really hard to manage the country with multiple cultures.

The first president George.Washington initiated an example of transferring the national power peacefully in the world. Following his footsteps, no president dared to surpass the boundary of the constitution. We can’t help imagining what would happen if the leader of the independence war was Napoleon, not Washington. To build a nomocracy tradition is very hard, but it’s rather simple to break it. China is facing up to the task to rebuild the law consciousness of the people. It’s really harder to rebuild the mutual trust between people after horror, but we have to complete this process. Without it, China can never be a great country again, for our country will never be a good place for any of us to live in, unless it’s a good place for all of us to live in.

Reading nomological books as a student major in science and engineering, I believe it’ll be helpful for students like me to enjoy the strict inference and logic of the law, which was once thought to be tedious and monotonous by most of us. Thus to enhance our qualities of all aspects and make us more thoughtful and mature in the process of accomplishing the goal of “Building a well-to-do society in an all-round way” in the foreseeable future.

The birth and the spirit of the U.S. constitution (1787)

 

After six year’s hard war, 13 North America’s colonies once belong to the Great Britain finally won the war of independence. However, the confederacy couldn’t make the colonies a united country. In order to solve the serious problems of the confederacy, represents of 13 colonies gathered in Philadelphia. Far from improving the constitution of the confederacy, they began to make a new constitution for the United States. The constitution was filled with fruits of compromise and balance. There is no country fear of the despotism as America, and there is no constitution thick with so many limits to keep away from it.

《The Declaration of independence》said: “We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty, and the pursuit of Happiness. That to secure these rights, Governments are instituted among Men, deriving their just powers from the consent of the governed. There is no doubt that the constitution of the U.S. inherited the spirit of the declaration.

There are some special points in the U.S. constitution: 1^st, the “Natural rights” are holy, every one is created equal. Life, freedom and property are the rights given by God; 2^nd, the contract of the society is holy. The government has to contract with people in order to get the legal rights to manage the country; 3^rd, the protection of the private wealth is holy. It can’t be invaded; 4^th, the freedom of religion is holy. All these mix together to compose the holy of the law

The endeavor of China and the miracle of the U.S. constitution

 

Due to reasons of history, Chinese people are still lack of the sense of law. Especially during the ten year’s notorious “Revolution of culture”, the spirit of law was taken place by the people’s movements and the power of the government. Political leaders rather than laws play the role of leading the country’s political life. It’s obviously “Rule by person”, rather than “Rule by law”.

Today, China is on its way of “Building a country ruled by law”. In China, the legislature of the country is the NPC (Short for National People’s Congress) and people’s congress of other lower classes. In fact, the core of the NPC —— the Standing Committee is made up of only more than one hundred law experts. Considering that China has more than 1.3 billion population, this institution is really a simple and efficient structure.

Let’s look across the Pacific Ocean and investigate the rules of the United States, since it is always regards itself has the best government with democracy and nomocracy all over the world. The constitution of the U.S. was published in 1787, more than two hundred years ago. It’s also the constitution with the longest age. How was the constitution born? How can Americans manage their country under a constitution unchanged? In what part does the Federal Supreme Court play in this process? Which rights does the court has and how did it own and use these rights? We may know more about the “democracy” and “nomocracy” of America after getting the answers.

Guide Words

With a constitution over 200 years, the United States has grown to be one of the strongest super countries in the history. How do Americans rule their country? Since many other countries have assassinations, dark trades or even wars during the process of transferring the national power, how can Americans peacefully transfer the national power without any barriers?

  Through reading books that tried to discuss the function of American constitution and the Supreme Court in the U.S. political life written by experts at home and abroad, I have understood much more about the famous words “Rule of Law” said by the chief justice John Marshall.

   The list has been announced. In the college, no one was eliminated. It was known in advance that the outcome of the battle. As a result, there is no excitement and elation. A test in which my future would partly be decided, has finally become a formality. What a loss!
   No interrogation, no embarrassment, no, of any unexpected difficulties. The unremarkable professional interview lasted less than ten minutes,in two-part of which the head of the dept. asked me to submit to regulation, with which I will never agree.
   All over.
   What will happen the next day?
   I don't know.
   Look around students looking for work, and preparing for postgraduate examination, Nobody more than I have leisure. Nobody more than I have moreto do.
  It's time to Re-scheduling.

2005年维也纳新年音乐会

 

　　马泽尔站在新年音乐会的指挥台上永远是这样一幅摸样，就连衣着服饰十多年来都没有任何变化——黑色燕尾服、深灰色西裤，里面则是浅灰色的西装马甲和银白色的领带。记忆中，1994年、1996年以及1999年，马泽尔都是以这样一个形象面对全球亿万电视观众的。更惊异于岁月似乎并没有在他脸上留下更多痕迹。2005年的维也纳新年音乐会因为一场灾难而改变了传统，也使得整场演出的气氛变得相对肃穆、凝重。在新年第一天不能看到一场预想之中充满激情幽默的音乐会，对观众而言自然有些遗憾，但我们却不得不为维也纳人、奥地利人体现出的这种细腻而善良的人文关怀精神所感动。

2003年维也纳新年音乐会

 

　　2003年哈农库特第二次亮相维也纳新年音乐会的指挥台，他在2001年曾经首度执棒新年音乐会，结果评价可谓毁誉参半。一方面，奥地利听众以及一部分乐评者对哈氏的演绎极为称道，把当年的音乐会誉为“最原汁原味的一届”。他们认为哈农库特采用了遵循施特劳斯创作本意的思路对曲目进行了极为贴切的诠释，而且从各方面都体现出了奥地利、维也纳的本土气息。当然一些反对者们则认为，哈农库特在指挥的时候神情过于严峻，丝毫没有把新年音乐会上应有的欢乐气氛引导、发挥出来，而且不少人对于他的选曲颇有异议，尤其是那着名的“拉德茨基开场白”！2003年的音乐会上，哈农库特却给我们带来了一丝新意。虽然老人家看起来又苍老了一些（或许是因为化妆师的原因），但是音乐中所表现出的活力却丝毫没有减退。哈农库特在指挥台上似乎更加活跃，选曲也更加丰富且具有创新了。我们听到了一些在往年新年音乐会上较少出现，甚至是首次出现的曲目。

2004年维也纳新年音乐会

 

2004年1月1日，意大利人里卡尔多•穆蒂第四次站在维也纳新年音乐会的指挥台上，前三次分别是在1993、1997以及2000年。而此番穆蒂一出场就给了观众一个与以往不同的形象——一副金色边眼镜配合他的服饰装扮更显出一份儒雅气质。虽然岁月不饶人，但穆蒂依然力图保持一份年轻的活力。而在这场盛会上，穆蒂一共挑选了7首第一次在新年音乐会中上演的曲目，所以给大家耳目一新的感觉。同时对于传统曲目的演绎，也显示出全新的创意。

2000年维也纳新年音乐会

 

千禧年的维也纳新年音乐会维也纳金色大厅请来了意大利人里卡尔多•穆蒂，而今年（2004年）的年度指挥也是他，除此之外穆蒂还执棒过1993和1997年的新年音乐会。在穆蒂的指导下，维也纳爱乐乐团在演奏中大胆地强调音乐地动态和对比，发掘出圆舞曲的另一种美态。2000年这场维也纳新年音乐会，穆蒂以“施特劳斯家族与世界各地的联系”为主题，选择了一些曲目，涉及意大利（《大湖圆舞曲》，选自约翰•施特劳斯的轻歌剧《威尼斯之夜》）、希腊（《海伦波尔卡》，约翰•施特劳斯1858年为希腊国王奥托登机25周年的纪念大典而作）、英国（《阿尔比昂波尔卡》，是约翰•施特劳斯给维多利亚女王的丈夫的作品）、匈牙利（《匈牙利舞曲》，选自约翰•施特劳斯的轻歌剧《骑士帕兹曼》）等多个施特劳斯父子生前访问过的国家。此外，还有约翰•施特劳斯的《爱之歌圆舞曲》、《美酒、女人和歌圆舞曲》、《波斯进行曲》、《诉讼过程快速波尔卡》和《高贵的匈牙利人、快速波尔卡》；爱德华•施特劳斯《特快邮车快速波尔卡》和《向布拉格致意，法兰西波尔卡》；约瑟夫•施特恼斯的《蜻蜓玛祖卡波尔卡》、《艺术家的致意，法兰西波尔卡》和《圣母之声圆舞曲》。下半场演出的第一首作品是奥地利作曲家苏佩的轻歌剧序曲《维也纳的早中晚》，乐曲描绘了维也纳市民的日常生活景象。维也纳新年音乐会每年都会选择一位非施特劳斯家族作曲家的作品，这也已经成为一种传统。除了传统的《蓝色多瑙河》以及《拉德茨基进行曲》外，另外一首反场曲则是《自多瑙河之滨，快速波尔卡》。

2001年维也纳新年音乐会

 

2001年元旦的维也纳金色大厅，新世纪第一场新年音乐会迎来了一个新面孔——奥地利本土指挥大师尼克劳斯•哈农库特。这位以崇尚本真主义为己任的指挥家为我们带来了一场气象一新的维也纳新年音乐会。哈农库特从衣着装饰到音乐处理，几乎每一个细节都体现出其本土化特质，所以当年的评论界认为这场音乐会是历年以来口味最为“地道”的一次。哈农库特赋予了这些舞曲以清新、纯正的听感享受，同时也凸现了自己的指挥风格，在他的指挥下维也纳爱乐乐团显现出一种与众不同的乾净音色。在选曲上，他意识大胆地用《拉德茨基进行曲》的原始版本作为开场，没有观众掌声的附和，体现出这首曲目最为纯朴的一面，也表现出哈农库特对本真的追求。下半场则以小约翰.斯特劳斯的歌剧《威尼斯之夜》的序曲开始，此后的三首长篇幅圆舞曲《奥地利村燕》、《百万富翁》以及《蓝色多瑙河》演绎也均十分出色。其他的小曲目则同样烁烁生辉，欢快而热情，尤其以正式曲目的最后一首《恶魔快速波尔卡》最为火爆，其中一名乐手带着恐怖的恶魔面具，在曲目即将结束之际，从一阵诡异的焰火中出现，将现场气氛推向最高潮。另外，音乐会上还将有3首Joseph Lanner（兰纳）的作品，以纪念这位维也纳圆舞曲的最早奠基者诞辰200周年。

2002年维也纳新年音乐会

 

2002年的维也纳新年音乐会无疑是充满着快乐和幽默气氛的，这源自于年度指挥家小泽征尔的独特艺术气质；更有评论认为，小泽将东西方文化的融合完美地体现在了斯特劳斯音乐作品中。小泽征尔在这场音乐会上的出色表现，赢得了广大观众的好评，更因为他在祝辞中以汉语问候新年好，更让广大华人感动不已。在整场音乐会上，小泽不时显露出他过人的幽默感，在乐团的配合下耍一些预先设计好的“小花样”，为这场盛会更添欢快喜庆的气氛。在传统曲目的演绎上，小泽体现出了属于自己的艺术风格。

1996年维也纳新年音乐会

 

　　著名指挥大师洛林•马泽尔是维也纳新年音乐会上的常客。从1980开始接替博斯科夫斯基执棒，他连续指挥了7届，此后又分别于1994、1996以及1999年三次登台。作为当代世界指挥中的天才巨星和中坚力量，马泽尔对驾驭斯特劳斯家族的舞曲作品别有心得，因此深得广大乐迷的心。而这位集小提琴演奏家与指挥家两种身份于一身的音乐大师屡次在新年音乐会上施展自己的器乐独奏绝技，展现出其多才多艺的一面以及别具匠心的幽默感。1996年那次，在每年例行的新年祝福段落，他更用汉语向广大中国乐迷问好，使人记忆犹新！在当年的演出中，马泽尔选择了诸多优雅欢快的作品，新曲目数量也相当之多。大师更在两首曲目中担任小提琴独奏，更在《Jockey Polka（骑手波尔卡）》一曲中亲自负责模拟鞭声的效果。唱片由美国RCA公司发行，这也是他们第一次参与维也纳新年音乐会的录制混音，整体音色充满着雄浑、厚重的色调，又不失活泼。企鹅评鉴给予三颗星的高度评价。

1999年维也纳新年音乐会

 

　　1999年的维也纳新年音乐会拥有两个特殊的含义，因为这一年是小约翰•施特劳斯逝世100周年以及老约翰•施特劳斯逝世150周年纪念。年度指挥洛林•马泽尔以1月1日在金色大厅举行的这场盛会，拉开了“施特劳斯音乐年”的序幕。因此在这一年的曲目安排中，主要是以这对约翰•施特劳斯父子的作品为主。三首首次出现在新年音乐会上的曲目——老约翰•施特劳斯的《Furioso-Galopp》、《Walzer a la Paganini（帕格尼尼圆舞曲）》以及小约翰•施特劳斯的《Hopser-Polka》。其中以《帕格尼尼圆舞曲》为当年音乐会上的最亮点，不但因为它首次亮相，也因为这首曲目将帕格尼尼小提琴协奏曲的旋律融入到圆舞曲中的独特效果，更因为指挥马泽尔在这首曲目的演奏过程中，再次亮相他的拿手好戏——担任小提琴独奏，给听众留下了非常深刻的印象。另外，自1994年之后马泽尔再次选择了《维也纳森林的故事圆舞曲》这一曲目，全新的演绎版本比此前更加优异。

1994年维也纳新年音乐会的年度指挥是洛林•马泽尔，这也是他继1986年之后，时隔多年重新走上这一盛会的指挥台。当年指挥家与乐团当局不合而暂停合作的往事，在多年之后双方都早已屏弃前嫌。马泽尔在指挥施特劳斯家族曲目方面拥有自己丰富的经验和独到的艺术见解，加之其自身幽默的天性，让整场音乐会充满着和谐的美感以及热烈的气氛。SONY公司的现场录音平衡感非常好，音色清晰而自然。着名的企鹅激光唱片指南给予这张唱片三颗星的高度评价，评语说：“洛林•马泽尔使1994年新年音乐成为有史以来最热烈的一场音乐会，他那种给人带来放松的快乐的演出方式是令人难以想象的”。

1995年维也纳新年音乐会

 

　　1995年，来自印度的大师祖宾•梅塔再次走上元旦的金色大厅，指挥当年的维也纳新年音乐会。在这场音乐会上，梅塔安排了两首初次亮相的新曲目——约瑟夫•施特劳斯创作的《塔利亚女神》马祖卡波尔卡舞曲以及爱德华•施特劳斯创作的《雷电波尔卡》。这两首在科堡历史卷宗中沉睡了长达一个多世纪之久的曲目，在这一年的新年音乐会上得以“重见天日”。除此之外，梅塔还安排了许多冷僻的曲目，譬如小约翰•施特劳斯的《骑兵进行曲》、《梅菲斯特的地狱呼唤》、《俄罗斯幻想进行曲》，约瑟夫•施特劳斯的《我的生平经历是爱与希望》以及老约翰•施特劳斯当年为维多利亚女王的女儿爱丽丝公主特别创作的《爱丽丝波尔卡》。这些曲目为这一古老的音乐盛会注入了许多新鲜的气息。传统曲目梅塔选择了《晨报》、《无穷动》等不多的几首，当然还有雷打不动的《蓝色多瑙河》以及《拉德茨基进行曲》。非施特劳斯家族的作品之收录了兰纳的《心爱的波尔卡》。正是曲目中的最后一首《射击者四方舞》尾声处的火爆的枪声，则作为本届音乐会的“娱乐节目”。录音混音依然由SONY公司担纲，音色清晰而明快，但厚度稍显不足。企鹅指南评价三颗星，并称：“1995年的新年音乐会超乎寻常地反映了指挥的个性——祖宾•梅塔——一个豪爽愉快的庆典大师；这次的曲目中有很大一部分是珍品……唱片很好地捕捉到了现场热烈的气氛。”

1992年维也纳新年音乐会

 

　　1992年元旦，时隔三年之后卡洛斯•克莱伯再次出现在金色大厅指挥新年音乐会。由于89年那次的大获成功，所以在92年正逢维也纳爱乐乐团150周年团庆之际，乐团方面特别邀请克莱伯出山。而这确实是一场极为珍贵的盛会，克莱伯在当年便功成身退，此后极少在公开场合进行演出。

1990年维也纳新年音乐会

 

1990年的元旦，维也纳引来了继卡拉扬、阿巴多、克莱伯之后第四位年度指挥—来自印度的祖宾•梅塔，这也是亚洲指挥家第一次登上维也纳新年音乐会的指挥台。在这场音乐会上，梅塔充分展示了他的指挥魅力，其豪爽的艺术举止、充满力度的指挥动作显得仪态万千，引人入胜，因此被誉为“最细致的维也纳新年音乐会诠释者”。
